For the moment we are discussing with the lawyer of the National Fans Association. What is clear is that Rani Assaf organizes the settlement in his own way. On the merits, was the ban on Saturday legally practicable? This is believed by the lawyer member of the National Association of Supporters, Pierre Barthélemy, who in the past had defended PSG’s private stadium fans, as part of the Leproux Plan (1). “I think it’s illegal. Neither the club’s bylaws nor the general conditions of sale prohibit entry with a tarp. What is prohibited is hate speech, these are signs of discrimination.”

A civil action?

The document governing the conditions of sale and subscription to Nîmes Olympique expressly prohibits the introduction, within the enclosure of the stadium, of “any document, flyer, badge, symbol or banner of any size, of a political, ideological nature, racist, religious or advertising. ” Not a banner with the name of a fan group. “The supporters’ association can be the subject of civil action, ed, denouncing the club’s ignorance of the contract it has drawn up with every fan, believes Pierre Barthélemy. But beyond that, there is also the possibility of a criminal complaint for discrimination. Because these supporters could not return here because of their membership in an association.

Rani Assaf does not deny it: it is the association that is targeted. “The GN association (Gladiators Nîmes 1991, ed) is not welcome. Individually, the supporters had the right to return. (…) They are the ones who refused to enter without equipment, banners and megaphone ”.

For Pierre Barthélemy, this prohibition is extremely rare. “We only saw it in Paris with the Leproux plan, although there are more hidden situations, for example in Nantes. But in the end, in Paris, the club had to compensate its fans in 2016”.

From the name of the former PSG president, Robin Leproux who, in order to eradicate the violence at the Parc des Princes following the death of a fan in 2010, had wanted to unsubscribe fans in the stands of Bouogne and Auteuil.
